Terms of Service

1. Who you're agreeing with

These Terms of Service ("Terms") are a binding agreement between you and Queri K.K., a company organized under the laws of Japan ("we," "us," "our"). Commit is a product of Queri Labs and is powered by the Queri Platform. The Terms govern your use of the Commit mobile application and the sayitpostitcommitit.com website (the "Service"; the legacy commit.queriapp.com addresses redirect there). By creating an account or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.

2. The point of the Service — read this one

Commit is a platform for delayed, irreversible publishing. You accept that:

• Sealed means sealed. Once you seal a post, direct message, or letter, you cannot edit it, and you cannot delete it. It will be delivered to the audience you chose at the time you chose.
• Cancelling has a price and leaves a mark. The only way to stop delivery is to cancel and incur the cancellation price you set when sealing. The item's content is then permanently hidden, but a redacted receipt — the fact you cancelled, and the amount — remains visible to the original audience and counts toward your visible totals (e.g., the "Class of Fail" board).
• Witnesses see it coming. Before delivery, your audience can see that something sealed is coming, its kind, its countdown, and your cancellation price — and can react and comment. The words stay sealed. One exception, and you should know it before you seal a photo or video: someone who can see the post may pay to look at that media early, briefly — see "Paid looks" in Section 5.
• Delivered content stays. Arrived posts remain on your record. There is no unsend.

If any of this is unacceptable to you, do not seal the item. Think before you seal.

3. Eligibility

You must be at least 13 years old (or the higher minimum age required where you live) and legally capable of entering into these Terms. If you are under the age of majority, you confirm a parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Your account

You are responsible for your account and everything sealed from it. Keep your password secure. Sign-up requires a username, a verified email address, and a password; if you forget your password, you can reset it using that email address. Handles and display names must not impersonate others or infringe rights. You may not sell, transfer, or share your account.

5. The commit mechanic in detail

• Sealing. When you seal an item you choose its audience (your circle for posts; a recipient for DMs and letters), its delivery time (subject to product minimums), and your cancellation price within the limits offered in-app.
• Delivery. We deliver sealed items on a schedule with reasonable technical tolerance (delivery is timer-driven and may occur within a short window around the scheduled time). Arriving is free.
• Cancellation. Cancelling before delivery incurs your self-set price. If you sealed the item with the optional price-doubling add-on, cancelling within the final five minutes before delivery incurs double your price. Without the add-on, your price never changes. The add-on is called "Double Down" in the app and on the site.
• Golden Tickets. If you hold a Golden Ticket you may spend it instead of paying: the cancellation goes through at no charge, the ticket is consumed, and the receipt still appears. Tickets are earned inside the app and are never sold — see Section 7.
• Receipts. Cancelled items leave a permanent redacted receipt visible to the original audience, showing the cancellation and its amount. Cancelled DMs and letters are hidden from their recipient, but your own record still reflects the cancellation.
• Instant messages. Chat threads also support ordinary instant messages outside the commit mechanic; these are plain messages with no timer, no price, and no receipt.
• Paid looks — photos and videos only. Anyone who can already see a sealed photo or video post may pay a fee to view that media before it ships. The fee is half the author's cancellation price (minimum USD 1), the media is shown for under a second, and it cannot be saved or downloaded. Text, voice notes, direct messages and letters can never be looked at this way — there is no way to buy words early. The author can see exactly who paid to look and when; everyone else sees only how many did.
• The pool — raising someone else's price (early access). Some accounts can pay to ADD to another person's cancellation price. Staked money joins that commit's pool and raises what cancelling costs its author; it is never paid out to anyone. An author's worst case is capped: base price, the Double Down doubling and the pool together can never exceed USD 200, so a take-back always stays purchasable.

6. Payments

How you pay. Cancellation fees are charged as an in-app purchase through Apple's App Store. When you confirm a cancellation the App Store shows you the amount and takes the payment; Apple is the merchant of record, and we never receive or store your card details. What reaches us is Apple's signed confirmation of that transaction, and that confirmation is what releases the cancellation. If you dismiss Apple's payment sheet, nothing is charged and the item stays on its timer — a cancellation you did not pay for did not happen.

Prices. The price you set in the app is expressed in US dollars. The App Store charges the equivalent price for your storefront, in your local currency, and the amount Apple displays before you confirm is the amount you pay.

Other charges. Two more things in the app take real money, through the same App Store purchase: a paid look at someone's sealed photo or video, and a stake added to someone's cancellation pool (both in Section 5). Neither is ever paid out to another user — a stake raises a price, it does not become anyone's income.

Golden Tickets. A Golden Ticket waives the fee for a single cancellation: no purchase is made and no money moves. Tickets are earned in the app and are never sold — see Section 7.

Refunds. A cancellation takes effect the moment it is paid for, and the payment is non-refundable once it does, except where required by law. Refunds for App Store purchases are requested from and decided by Apple under its own policies; we cannot reverse an Apple charge ourselves.

Your record. Every cancellation is recorded on your account with its amount, and that record — plus the redacted receipt described in Section 2 — remains visible to the item's original audience and counts toward your visible totals.

7. Virtual items and the crane game

The Service includes a free mini-game (the "crane game," reached through the daily bonus) and items it hands out — play credits, cheer cards, letter stamps and other cosmetic unlocks, and Golden Tickets. Those, and every other in-app item, are virtual items, governed by this section:

• Free to play; nothing to buy. Play credits are granted free — three per day, restocking at midnight Japan time — and may also be gifted to you by another user out of their own free credits. We do not sell credits, prizes, plays, or odds, and there is no way to obtain any virtual item with money. No payment of any kind improves your chances.
• No monetary value. Virtual items have no cash value. They are not money, currency, credit, property, or a stored-value instrument. They cannot be redeemed, exchanged, or cashed out for money or anything of value outside the Service, and they may not be sold, traded, or transferred to anyone except as the app expressly allows (gifting spare play credits to another Commit user).
• A licence, not ownership. You receive a personal, revocable, non-transferable, non-sublicensable licence to use virtual items within the Service. You do not own them, and no right in them exists outside the app.
• Random outcomes. Which prize a ball holds, and whether a grab succeeds, is determined by our servers on odds we set; some prizes are deliberately much harder to win than others. Because play costs nothing, cannot be bought, and nothing won can be converted into money, the game is not a wager, lottery, or paid loot box.
• Expiry and changes. Daily credits do not roll over; gifted credits expire 30 days after they are sent. We may rebalance, change, suspend, or discontinue the game, any item, or any odds at any time, and items may be removed in the process. Because virtual items have no monetary value, no refund or compensation is owed for any item that expires, is lost, is changed, or is discontinued.
• Forfeiture. Virtual items are tied to your account. They are forfeited without compensation if you delete your account or we suspend or terminate it, and they cannot be inherited or moved to another account.
• Golden Tickets. A Golden Ticket waives the cancellation price on a single item (Section 5). Tickets are earned in the app — for finishing the starter missions, or as a crane prize — and are never sold. Spending one is not a payment and is not a refund.
• Fair play. Manipulating the game — automating play, tampering with the app or its traffic, exploiting a bug to mint credits or prizes, or using multiple accounts to farm them — is a breach of Section 9, and we may remove the items and the accounts involved.

8. Your content and license to us

You own the content you create. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for technical display), transmit, and display your content solely to operate, provide, and improve the Service — including continuing to display delivered content and cancellation receipts to their audience as described in Section 2. This license lasts as long as your content remains on the Service. You represent that you have all rights needed to post what you post.

9. Prohibited conduct

You agree not to:

• Post content that is illegal, infringing, defamatory, harassing, threatening, or that sexualizes minors — or use the delay mechanic to schedule such content;
• Use the Service to threaten, blackmail, extort, or coordinate harm (the irreversibility of the mechanic is not an excuse — you chose to seal it);
• Impersonate any person, misrepresent affiliation, or access another person's account;
• Probe, disrupt, reverse engineer, scrape at scale, or overload the Service, or circumvent its security or its delivery/cancellation mechanics;
• Use the Service for spam or unsolicited commercial content.

10. Reporting, moderation, and the one exception to "no delete"

Anyone in a sealed item's audience can report it, and any user can report delivered content or accounts. Reported pending items may be paused (their timer stops and they are hidden) while a human reviews them. After review, we may restore an item (its countdown resumes with the time it had left), remove it, or remove the account. We may also remove content or suspend accounts without a report where necessary for legal compliance or user safety. Moderation removal is the one way content leaves the record without a cancellation receipt.

11. Third-party services

The Service depends on third-party providers (including Apple's and Google's app distribution and push notification services, and the cloud providers described in the Privacy Policy). Your use of the app is also subject to the terms of the platform you installed it from (e.g., Apple's standard EULA or the Google Play Terms of Service).

12. Our intellectual property

The Service, including its software, design, and branding ("Commit," the Commit wordmark, "Queri," "Queri Labs," and the Queri Platform), belongs to us and our licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the app for its intended purpose. No other rights are granted.

13. Termination

You may stop using the Service at any time and may request account deletion as described in the Privacy Policy. We may suspend or terminate your access if you violate these Terms, create risk for other users or us, or where required by law. Sections that by their nature should survive (including 6, 7, 8, 14–17) survive termination.

14. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that delivery will occur at an exact instant, that the Service will be uninterrupted or error-free, or that content other users seal is accurate or lawful. You alone are responsible for what you choose to seal, knowing it cannot be taken back.

15. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or reputational harm (including harm resulting from content you sealed and could not retract), arising out of or relating to the Service. Our aggregate liability for all claims will not exceed the greater of (a) the amounts you actually paid us in the twelve months before the claim, or (b) USD 100.

16. Indemnity

To the extent permitted by law, you will indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or of another person's rights.

17. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. Subject to any mandatory consumer protections where you live, the Tokyo District Court has exclusive jurisdiction as the court of first instance over disputes arising from these Terms or the Service. Before filing, you agree to try to resolve any dispute with us informally by contacting hello@sayitpostitcommitit.com.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, provide notice in the app. Continuing to use the Service after changes take effect means you accept them. If you do not accept, stop using the Service.

19. Miscellaneous

These Terms (with the Privacy Policy) are the entire agreement between you and us about the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
